5. Drought Contingency Violation Enforcement Schedule.
In accordance with the District’s Drought Contingency Plan and to ensure the responsible use and preservation of water resources during drought conditions, the following enforcement schedule shall apply to all customers:
(A) Violation Schedule.
There will be a minimum of two (2) days between each issued violation in order to give customers the opportunity to make corrections as necessary.
- First Violation – Customer will be contacted and a physical notice of violation.
- Second Violation – Customer will be contacted, physical notice of violation, and be assessed a $75.00 fee.
- Third Violation – Customer will be contacted, physical notice of violation, disconnection of water service, and be assessed a $250.00 fee.
- Fourth Violation – Customer will be contacted, physical notice of violation, disconnection of water service, and be assessed a $500.00 fee.
- Subsequent Violations – Customer will be contacted, physical notice of violation, disconnection of water service, and be assessed a $500.00 fee.
(B) Meter Size Adjustment for Violation Fees.
The fees referenced above apply to standard 5/8" meters. For meters larger than 5/8", the fee shall be calculated based on 50% of the equivalent meter size relative to a standard 5/8" meter as shown in Section 4.B.1 of this Rate Order. For example, a 2" meter is equivalent to eight (8) 5/8" meters. Therefore, a fourth violation for a 2" meter would result in a $2,000 fee (i.e., $500 × 8 × 50%).
(C) Disconnection and Reconnection.
Service disconnections due to drought contingency violations shall follow the procedures established in Section E.13 of this Rate Order.
(D) Grace Period for New Construction.
The District recognizes the need for lawn establishment following new home construction. Therefore, a grace period of twenty (20) days from the date of customer account activation (transition from the builder) shall be granted for irrigation purposes. During this period, drought contingency enforcement will not apply.
(E) Grace Period Ineligibility.
Home Builders and Developers are not eligible for the grace period stated above and must comply with the watering schedule outlined in Section I 7.3.
